These Terms and Conditions constitute the legal basis governing the use of the Zatoka online store. Trójmiejski design, located at www.fpalma.pl/The store is owned by the Palma Foundation, with its registered office in Gdańsk (80-041) at ul. Uranowa 12c/30, entered in the National Court Register: Register of Associations, Other Social and Professional Organizations, Foundations, and Independent Public Healthcare Institutions under KRS number: 0000692381, with Tax Identification Number (NIP) 5833261974.
The content of the online store www.fpalma.pl/sklep—including its structure, graphics, company and brand logos, content and informational articles, illustrative images, and product photos are the property of the Palma Foundation and are protected by law in accordance with the Act on Copyright and Related Rights of February 4, 1994 (Journal of Laws of 2000, No. 80, item 904, as amended).
No substantive or graphic content (articles, content, photos, graphics) may be distributed in print, electronic, or online publications without the consent of the store owner.
A condition for using the online store—in particular, placing orders and using interactive features after registration—is the prior acceptance of all provisions of these Terms and Conditions and the User’s commitment to comply with them properly.
The User accepts all provisions of these Terms and Conditions.
Any natural person with full legal capacity who is registered with the www.fpalma.pl/sklep online store may use the store, including, in particular, the right to enter into sales contracts.
The online store www.fpalma.pl/sklep is a store owned by the Palma Foundation, accessible at the domain www.fpalma.pl/The store is owned by the Palma Foundation, headquartered in Gdańsk (80-041) at ul. Product – a movable item presented in the online store at www.fpalma.pl/sklep.
User – a natural person with full legal capacity who uses the online store at www.fpalma.pl/sklep.
Registered User – a user who has registered on the www.fpalma.pl/sklep online store website, has their own username and password, and has access to all interactive features of their store account.
Customer – a Registered User who has placed an order (or intends to do so) in the online store at www.fpalma.pl/sklep.
The products offered for sale in the online store are new and free from defects. Each product has a detailed description in the online store regarding its dimensions and the materials from which it is made. Before making a purchase, the Customer must review all product information provided in the online store.
Placing an order is considered acceptance of all descriptive information regarding the entire product and its components.
Photos of all products have been taken with due care to capture as many details as possible regarding their appearance and to accurately represent their actual appearance—in particular, colors, patterns, and shapes. Photos and graphics are therefore an integral part of the product description. Any differences between a photo and the actual product may result from the individual settings of each computer (e.g., the color, proportions, and size of the product may vary on different monitors) and do not constitute grounds for a complaint regarding the purchased product.
The prices of all products offered in the online store are listed in Polish currency (Polish zloty—PLN) and are gross prices. Prices do not include shipping costs.
The owner reserves the right to change the prices of products offered in the online store, in particular to conduct promotional campaigns.
The prices of each product are binding on the Customer upon receipt of an email confirming the placement of the Order. The Palma Foundation is not liable for failure to deliver the order confirmation email due to reasons beyond its control, such as an incorrect email address or the email being filtered into the spam folder. Details of the placed order are also available in the Customer’s “MY ACCOUNT” profile in the online store.
To purchase products from the online store, you must first register correctly on the website, then fill out the order form (all required fields must be completed accurately), and make payment for the ordered products.
Orders can be placed 24 hours a day; however, the order processing time is calculated from the moment the funds sent by the customer are credited to the Palma Foundation’s account on a business day between 9:00 a.m. and 5:00 p.m. (i.e., Mon.–Fri., excluding public holidays). If payment confirmation is received at the Palma Foundation’s email address on a holiday or after 5:00 PM, the order will be processed on the next business day.
If an order that has already been paid for cannot be fulfilled, the Palma Foundation reserves the right to cancel the order (due to lack of product availability) and will immediately notify the Customer. If the Customer does not express a desire to purchase another product, the Palma Foundation will refund the Customer’s money as soon as possible to the account from which the payment was made.
The Customer may cancel or modify an order only until they receive an email confirming shipment to the address provided on the order form (this timeframe corresponds to the order fulfillment period).
Cancellation or modification of an order may only be made in writing—that is, via email sent to info@fpama.pl
Tickets purchased for an event are non-exchangeable and non-refundable. Exceptions apply only in the event of cancellation or a significant change in the time or location of the event. For refunds in such cases, please contact us at: info@fpalma.pl (Provision of Article 38 in conjunction with Article 27 of the Act of May 30, 2014, on Consumer Rights (Journal of Laws of June 24, 2014).
The customer transfers the amount equivalent to the order directly to the Palma Foundation’s account via the Przelewy24 service.
The www.fpalma.pl/sklep store cannot process an order without prior payment.
After sending the payment using one of the methods listed above, the Customer will receive an email within a few minutes confirming that the online payment for the ordered products has been received.
The www.fpalma.pl/sklep store processes the order immediately upon receipt of payment from the Customer into its bank account. The Customer is notified of this via an email sent automatically by the store’s electronic system.
The order fulfillment time is specified in business days in the product descriptions. If the waiting time for a product is extended, the Customer will be notified immediately via email.
Processing time refers to the number of business days required to physically manufacture the product (if it is not fully ready) or to prepare it for shipment and dispatch. If a customer places an order for products with different fulfillment times, the order will be fulfilled according to the longest fulfillment time and shipped together in a single package. Delivery time (courier) is not included in the fulfillment time.
For each order, on the day the payment is posted, the Palma Foundation may issue an invoice at the Customer’s request.
Once www.fpalma.pl/sklep has shipped the ordered products, the Customer is notified in the MY ACCOUNT section of the store’s website as well as via an email automatically sent by the store’s electronic system.
The expected delivery time for a courier shipment is 1–2 business days from the date of shipment.
When fulfilling special orders, www.fpalma.pl/sklep reserves the right to delay fulfillment due to extended delivery times for materials; the customer will be notified of this via email.
The www.fpalma.pl/sklep,wysyła store ships orders within Poland via Poczta Polska (Polish Post) as a registered letter or priority registered package, via a courier company, or via a package locker service. The customer is immediately notified of shipment via an email automatically sent from the www.fpalma.pl/sklep system.
The shipment should reach the customer in accordance with the delivery date specified by InPost.
InPost delivers the shipment on the specified date. For courier shipments, delivery takes 1–2 business days. For Parcel Lockers, the customer is required to personally pick up the shipment at the location selected when placing the order.
The store is not liable for extended delivery times and cannot guarantee that the delivery person will contact the Customer by phone if they do not find the Customer at the address provided in the order form. The delivery service is responsible for arranging a specific date and time for pickup directly with the customer, as well as for any delays in delivery.
Orders with a recipient address outside Poland but within the European Union may be shipped via Poczta Polska (Polish Post) as a priority registered shipment for the applicable fee for this type of shipment.
Shipping costs for products ordered from thewww.fpalma.pl/sklep online store within Poland and to other European Union countries are covered by the Customer.
Shipping costs for ordered products sent via Poczta Polska are listed separately for each product available in the online store at www.fpalma.pl/sklep. These costs include the price of the Poczta Polska service and packaging costs. The same rules apply to courier shipments and parcel lockers.
Upon receiving the shipment, the Customer is required to inspect the condition of the shipment before signing the delivery receipt.
Ordered products should be packed in a bubble wrap envelope or other cardboard packaging (e.g., tube, cardboard box).
Even if the shipment arrives intact, the Customer is required to open it in the presence of the delivery person.
If anything raises the Customer’s concerns—such as damaged or tampered packaging (whether from opening or otherwise), damage to the outer or inner packaging, or if the contents of the shipment are damaged or do not match the order—the Customer must categorically refuse to accept the delivered shipment. Immediately, in the presence of the delivery person, a damage or shortage report must be drawn up, and without delay—i.e., on the day of delivery—contact the store at www.fpalma.pl/sklep via email: info@fpalma.pl, describing the situation.
If the Customer does not contact us on the day of delivery, the contents of the shipment are deemed to have been delivered in accordance with the contract.
The completion of a delivery report drawn up in the presence of the delivery person serves as the basis for accepting and acknowledging the claim.
If the Customer accepts and signs for the shipment without first inspecting it, the risk of damage to its contents or any shortages passes to the Customer at the time of signing for receipt.
If the Customer does not accept the shipment within 14 business days and the ordered product is returned to the store during that time, it is deemed that the Customer has withdrawn from the sales contract. Consequently, within 14 business days of www.fpalma.pl/sklep receiving the return, the Customer will receive a refund for the ordered but unclaimed products. Shipping costs are non-refundable.
Every Customer has the right to withdraw from the contract within 14 days of the delivery date without providing a reason. The returned product must not have been used, must not be damaged, must not show any signs of use, and must be clean and free of any defects.
To withdraw from the sales contract, the Customer must, within 14 days, submit a statement of withdrawal from the sales contract and send it electronically to info@fpalma.pl. The statement must be printed, signed, and included with the shipment containing the returned products. A product may be returned provided that it is in its original packaging, shows no signs of use, and has no damage, defects, or flaws. A sample withdrawal form is provided at the end of these Terms and Conditions.
A customer who intends to withdraw from the contract is required to coordinate the details with the www.fpalma.pl/sklep store via email (info@fpalma.pl) and then ship the purchased product at their own expense to the following address: Fundacja Palma, ul. Baczyńskiego 8b/14, 80-410 Gdańsk, “RETURN.”
The shipment containing the returned or claimed product must be placed in appropriate packaging to prevent damage during transport, along with the original packaging (if it was shipped in such packaging), proof of purchase (receipt or VAT invoice), and a statement of withdrawal from the sales contract.
The www.sklep.fpalma.pl store, reserves the right to refuse to accept a shipment that does not meet the safe transport requirements described in Section 4, § 12, and thereby refuse to refund the product’s value on the grounds that the necessary conditions for withdrawal from the sales contract have not been met.
A shipment designated as a “return” cannot be sent “cash on delivery” or at the expense of the www.fpalma.pl/sklep store.
The customer is required to have proof of shipment—therefore, the return shipment must be sent by certified mail or courier service.
The www.fpalma.pl/sklep store is not liable for any damage to or loss of the shipment during transit.
Upon receipt of the package containing the product and the additional items listed in point 4 of this paragraph, the store www.fpalma.pl/will, within 7 business days of receiving the package, refund the equivalent value of the product, minus shipping costs, to the Customer’s account from which the payment was made. Shipping costs incurred by the Customer when returning the product are not refunded by www.fpalma.pl/sklep.
The Customer is not entitled to withdraw from the sales contract and, consequently, to return a product purchased at www.fpalma.pl/sklep if it was custom-made to the Customer’s specifications.
Whenever a sold product has a physical defect (non-conformity of the item sold with the contract) or a legal defect (warranty), you must contact the www.fpalma.pl/by sending an email to info@fpalma.pl with details regarding the issue. A response to the complaint will be provided within 10 business days and will include an offer for repair, replacement, or reimbursement of the costs incurred by the Customer.
The defective product must be shipped at the Customer’s expense to the following address: Fundacja Palma, Uranowa 12c/30, 80-410 Gdańsk, with the note “COMPLAINT.”
The shipment and the product subject to the complaint must meet the requirements described in § 12.
If the product sold has a defect, the Customer may request a price reduction or withdraw from the contract, unless the online store www.fpalma.pl/immediately replaces the defective product with a non-defective one or remedies the defect without undue inconvenience to the Customer. This limitation does not apply if the product has already been replaced or repaired by the online store www.fpalma.pl/sklep.
If the product sold is defective, the Buyer may:
– request replacement of the product with one free of defects,
– request that the defect be remedied,
– submit a request for a price reduction,
– submit a notice of withdrawal from the contract.
The Buyer may not withdraw from the contract if the defect is minor.
Damage or defects resulting from improper or careless use (mechanical damage, accidental events, crushing, distortion of the original shape, scratches) cannot serve as grounds for a complaint.
A complaint regarding non-delivery of a shipment may be filed only after 4 business days have elapsed from the date of receiving the email confirming shipment of the purchased products. A delivery person who does not find the Customer at the address provided in the order should leave a delivery notice. However, if 4 business days have passed and no one has contacted the Customer to arrange delivery, the Customer is required to notify the store at www.fpalma.pl/sklep of this fact.
If a product was damaged during shipping, a claim regarding such damage must be filed no later than the day the package is received. The customer must prepare a report describing the damage incurred during shipping and have it signed by both the customer and the delivery person. Claims for damage incurred during shipping submitted without a report signed by both the recipient and the delivery person will not be considered.
If the complaint is upheld (e.g., the shipment was lost or damaged by the delivery person), the customer will receive a full refund of the amount paid to the www.fpalma.pl/sklep store to the account from which the payment was made.
Complaints regarding differences in the product’s appearance between the photo and the actual item, resulting from computer settings, do not constitute grounds for a product complaint.
Details regarding the Seller’s warranty for defects are governed by the provisions of the Civil Code (Articles 556–576).
By placing an order or registering on the online store www.fpalma.pl/sklepKlient, you voluntarily consent to the use and storage of your personal data for the purpose of fulfilling the sales contract and providing post-sale support. This data is not shared with any other entities or individuals and is legally protected in accordance with the Personal Data Protection Act of August 29, 1997 (consolidated text of July 6, 2002, Journal of Laws 2002.101.926).
Every Customer has the right to access, modify, or delete their data from the www.fpalma.pl/sklep database
The Seller provides Customers with a free electronic newsletter service.
The Newsletter service is provided 7 days a week, 24 hours a day. The Seller reserves the right to select and change the type, form, time, and method of providing access to the selected services listed above, and will notify Customers of such changes in a manner appropriate for amendments to the Terms and Conditions.
Any Customer who enters their email address using the registration form provided by the Seller on the Store’s Website may use the Newsletter service. After submitting the completed registration form, the Customer immediately receives a confirmation from the Seller via email to the email address provided in the registration form. At that moment, a contract for the electronic provision of the Newsletter service is concluded.
The Newsletter service consists of the Seller sending, to the email address provided, electronic messages containing information about new products or services offered by the Seller. The Newsletter is sent by the Seller to all Customers who have subscribed.
Each Newsletter sent to specific Customers contains, in particular: information about the sender, a completed “subject” field specifying the content of the message, and information about the option to unsubscribe from the free Newsletter service and how to do so.
The Customer may opt out of receiving the Newsletter at any time by unsubscribing via the link included in every email sent as part of the Newsletter service or by checking the appropriate box in the Customer Account.

Palma Foundation/www.fpalma.pl/The store reserves the right to amend part or all of these Terms and Conditions, which shall take effect on the date of their publication on the online store’s website at www.fpalma.pl/sklep. The version of these Terms and Conditions in effect at the time the Customer placed the order shall always apply.
Matters not covered by these Terms and Conditions are governed by generally applicable laws: the Civil Code, the Act on Special Terms and Conditions of Consumer Sales and on Amendments to the Civil Code, and the Act on the Protection of Certain Consumer Rights and on Liability for Damage Caused by a Dangerous Product.
Any disputes arising during the performance of the sales contract shall be resolved amicably between the parties and, only as a last resort, adjudicated by the court having subject-matter jurisdiction over the location of the Palma Foundation’s registered office.

In matters not covered by these Terms and Conditions, the provisions of generally applicable law shall apply, including, in particular, the provisions of the Civil Code and the Act of May 30, 2014, on Consumer Rights.
